HIDEUS Studio
1. Scope and Provider
These Terms and Conditions govern all contracts between you as the consumer and HIDEUS Studio UG (haftungsbeschr.) (referred to as “HIDEUS Studio”, “we”, or “us”) for purchases of products through our online store. HIDEUS Studio UG (haftungsbeschr.) is a company registered in Germany, with business operations based in 30853 Langenhagen, Germany. We offer our products exclusively to end consumers (B2C) for personal use, not for resale or commercial purposes. By placing an order on our website, you confirm that you are a consumer (not a business) and you accept these Terms and Conditions. The contract language is English.
2. Offer and Conclusion of Contract
The product listings in our online shop are an invitation for you to place an order and do not constitute a legally binding offer. By completing the checkout process and clicking the “Place Order” (or similarly labeled) button, you are submitting a binding order for the items in your cart. After receiving your order, we will send you an order confirmation by email, which acknowledges receipt of your order. This order confirmation does not yet constitute acceptance of your order unless explicitly stated. A binding sales contract is formed only when we accept your order by sending a confirmation email stating that the order is confirmed/accepted or by dispatching the goods to you. We reserve the right to refuse any order on a case-by-case basis, for example, if a product is unavailable or if there is a suspicion of fraudulent activity. In such cases, we will inform you promptly and refund any payment that has been made.
3. Pre-Order and Delivery Time
Our current sales operate on a pre-order model. This means that many items are produced or prepared only after an order is placed. By ordering, you acknowledge that there may be an extended production and handling period before shipment. The estimated timeframe for pre-order items can range from approximately 3 days up to 90 days from the order date, depending on the product and production schedule. We will provide an estimated shipping date for your order and keep you updated on any significant delays. If we are unable to deliver the product within the stated timeframe, you have the right to cancel your order and receive a full refund. Partial shipments: If your order contains multiple items with different availability times, we may ship available items separately to expedite their arrival, unless you request a single shipment. You will not be charged additional shipping fees for any split shipments due to pre-order timing.
4. Prices and Payment
All prices displayed on our website are in Euros (EUR) and include value-added tax (VAT) as required by law for deliveries within the EU. Shipping costs are not included in the listed product prices and will be added at checkout if applicable. You will be able to review any shipping fees before finalizing your order. We accept the following payment methods: Visa, MasterCard, American Express, Maestro, Apple Pay, Google Pay, Klarna, Shop Pay, China UnionPay, and PayPal. Payments are processed securely via our payment provider (Shopify Payments). By submitting an order, you are authorizing us (and our payment processor) to charge the provided payment method for the total order amount, including any shipping fees and taxes. Payment is due immediately upon order placement (unless you choose a payment method like Klarna that offers payment after delivery; in such cases, the terms provided by that payment service will apply). We do not charge any additional fees for using any of the accepted payment methods. If a payment cannot be processed (e.g., the transaction is declined), the order will not be completed/confirmed, and we will inform you to arrange an alternative payment method.
5. Shipping and Delivery
We ship our products to selected countries worldwide from our facility in Langenhagen, Germany. Unless otherwise agreed, delivery will be made to the address you provide during checkout. We use DHL as our shipping partner for reliable, tracked delivery. The overall delivery time for your order depends on both the production time (see section 3 above regarding pre-orders) and the shipping transit time. Once your order is dispatched, typical transit times are approximately: 1–3 business days within Germany; 3–7 business days within the European Union; and 7–14 business days for destinations outside the EU. Please note these transit times are estimates and actual delivery can vary due to factors outside our control (for example, customs clearance procedures, carrier delays, or local delivery conditions). We will provide you with a shipment confirmation and a tracking number by email as soon as your order is handed over to DHL. From that point, DHL is responsible for the transportation of the package. If a delivery to you fails for reasons within your responsibility (for example, you provided an incorrect address or you did not collect the package from a pickup facility within the carrier’s deadline), and the shipment is returned to us, we may charge you for the costs of the unsuccessful shipment and any reshipping, or treat the contract as canceled if delivery proves impossible.
6. Shipping Costs and Customs
Shipping costs are calculated based on the destination country and the total order value, and they will be clearly shown at checkout before you finalize your order. We offer free standard shipping within Germany for orders with a merchandise value of €100 or more (after any discounts or promotions). For orders below €100 within Germany, a flat shipping fee will apply (the exact amount will be displayed at checkout). For international orders (including within Europe outside Germany and worldwide destinations), shipping fees vary by region and will be indicated at checkout. Any import duties, taxes, or customs fees that may be levied on an international order (outside the EU, or for example in Switzerland, UK, USA, etc.) are the responsibility of the customer. We have no control over these charges and cannot predict their exact amount since customs policies vary widely from country to country. If you are ordering from outside the European Union, please check with your local customs office about any potential import fees before ordering. You will be considered the importer of record and must comply with all laws and regulations of the destination country. Please also note that customs procedures may delay the delivery of your order beyond the transit times we have estimated.
7. Right of Withdrawal (Cancellation)
If you are a consumer residing in the European Union (or another country in the European Economic Area), you have a legal right to withdraw from your purchase contract within 14 days of receiving your goods, without giving any reason. The withdrawal period will expire after 14 days from the day on which you (or a person designated by you, other than the carrier) acquire physical possession of the goods. To exercise the right of withdrawal, you must inform us (for example, by an email to our support at hello@hideus.de) of your decision to cancel the contract by a clear statement. You may use the model withdrawal form provided by EU law, but it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the 14-day period has expired. If you withdraw from the contract within this period, we will reimburse all payments we have received from you, including, if applicable, the cost of standard delivery to you (we will not reimburse supplementary costs if you chose a more expensive delivery option than our standard delivery). We will make the reimbursement without undue delay and not later than 14 days from the day on which we are informed about your decision to withdraw. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier. You must send back or hand over the goods to us at the return address we provide, without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal to us. You will have to bear the direct cost of returning the goods (unless we agree otherwise or we are obligated by law to cover those costs in certain jurisdictions). You are only liable for any diminished value of the goods if such loss in value is due to handling them in a way that is not necessary to ascertain the nature, characteristics, and functioning of the goods (in other words, you can try on clothing as you would in a physical store, but do not wear it outside or remove tags if you might return it).
8. Voluntary Extended Return Policy (30 Days)
In addition to your statutory rights, we voluntarily offer an extended return period of 30 days from the date of delivery. This allows you to return or exchange products even after the 14-day legal cancellation period has passed. Within these 30 days, you may return item(s) for a refund or exchange, provided that all return conditions are met (see section 9 below). To initiate a return or exchange under this policy, you should contact us (e.g., via email at hello@hideus.de) within the 30-day period. This extended return policy is offered on a goodwill basis and does not limit or affect your legal rights. During the initial 14-day period, your right of withdrawal as described above applies. The period from day 15 to day 30 is a voluntary extension by us. We reserve the right to refuse a return or exchange under this extended policy if the conditions are not met or if the request is made after the 30-day window has lapsed.
9. Return Conditions and Procedure
To be eligible for a return or exchange (whether under the legal 14-day withdrawal or our 30-day extended policy), the products must be returned in original condition. This means the clothing should be unworn, unwashed, and undamaged, with all original tags and packaging intact. Please take care to neatly repackage items to avoid damage in transit. To start the return process, please contact our customer service (for example, by emailing hello@hideus.de with your order number and return request). We will provide you with the return instructions and the return address (which is in Germany). Unless the return is due to a product defect or an error on our part, you will be responsible for the return shipping costs. We recommend using a tracked shipping method for returns to ensure the package reaches us safely. Once we receive the returned item and confirm it meets the return criteria, we will process your refund or exchange. Refunds are typically processed within 14 days of our receipt of the return and will be made to the original payment method. If you requested an exchange, the replacement item will be shipped after we have processed the returned item; if the exchange item is not available, we will inform you and issue a refund instead. Please note that if you return an item after the initial 14-day withdrawal period (i.e., using our extended return policy), the original shipping fee (if any) may not be refunded, except in cases of full order returns as per our policy.
10. Defective or Wrong Items; Warranty
If the product you received is defective, damaged, or not the item you ordered, you are entitled to a remedy under statutory warranty laws. In such cases, please notify us as soon as possible (preferably within 7 days of delivery) by contacting our support (email: hello@hideus.de) and providing details of the issue along with any relevant photos. We will work with you to arrange a solution. This may include sending you a replacement product (if available) or providing a repair if appropriate, or otherwise offering you a full refund. In the case of a justified defect or wrong delivery, we will bear the cost of return shipping (we will either provide you a prepaid return label or reimburse your return postage) and any reshipment of a replacement. Nothing in these Terms and Conditions affects the statutory warranty (liability for defects) that we owe to consumers in the EU. Generally, the legal warranty period for new goods is two years from the date of delivery. This means that if a product was inherently defective or not as described at the time of delivery, you have the right to request a repair or replacement within that period (or a refund if the issue cannot be resolved). Minor deviations in color or other variations that do not affect the functionality or value of the item are not considered defects. Your statutory rights remain in full effect alongside this contract, and we will honor all legal obligations regarding product quality and conformity.
11. Retention of Title
Until full payment for an order is received, the products remain the property of HIDEUS Studio UG (haftungsbeschr.). We retain legal title to any goods shipped until the purchase price and any applicable shipping fees are paid in full. Once we have received complete payment, ownership of the goods will automatically transfer to you.
12. Liability
We accept unlimited liability for damages arising from injury to life, body, or health caused by our negligence or willful misconduct, as well as for damages caused by intentional misconduct or gross negligence on our part. In cases of slight (ordinary) negligence, we will only be liable for breach of essential contractual obligations. Essential contractual obligations (sometimes called cardinal obligations) are those duties that are fundamental to the contract, the fulfillment of which is a prerequisite for the proper execution of the contract and on which you may regularly rely. In such cases (slight negligence breaching an essential obligation), our liability is limited to the typical and foreseeable damages at the time of contract conclusion. We will not be liable for slight negligence breaches of non-essential obligations. The above limitations of liability shall not apply in cases where mandatory statutory liability applies, such as under the German Product Liability Act (Produkthaftungsgesetz), or in the event of fraudulently concealed defects or a guarantee of quality that we may have expressly given.
13. Applicable Law
These Terms and Conditions and all contractual relations between you and HIDEUS Studio UG (haftungsbeschr.) are governed by the laws of the Federal Republic of Germany, to the extent that this does not deprive you of mandatory consumer protection provisions of your home country. This choice of law means that, in matters not governed by mandatory consumer laws, the contract is interpreted and enforced according to German law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply. If you are a consumer resident in another EU/EEA country, you also enjoy the protection of the mandatory provisions of the law of that country (per Article 6 of EU Regulation (EC) 593/2008, “Rome I”).
14. Dispute Resolution
The European Commission provides a platform for Online Dispute Resolution (ODR), which you can access at https://ec.europa.eu/consumers/odr. This platform is a resource for resolving disputes that may arise out of online transactions. However, we value direct communication with our customers and prefer to address your concerns personally. You can contact us directly at hello@hideus.de with any complaints or issues, and we will do our best to resolve them. We also inform you that we are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle). This means we generally do not engage in third-party arbitration for consumer disputes, but this does not affect your rights to seek legal remedies.
